I’m not a lawyer but Nick Rekieta is and he did a video on this very topic and he seemed to suggest that yes, you can be fired.

And to people who like throwing “HIPPA” around, it’s not “HIPPA”, it’s “HIPAA”.

Houston hospital suspends 178 employees who refused Covid-19 vaccine

    It has begun!

A Houston, Texas, hospital has suspended 178 of its staff members who have refused to abide by its mandate that employees be fully vaccinated by Monday.

But the 178 unvaccinated employees who did not obtain religious or medical exemptions were suspended without pay, including 27 who are only partially vaccinated.

That is unacceptable to have suspended and most likely be fired because of this unjust mandate.

There are 285 unvaccinated employees who received a medical or religious exemption, and another 332 who were granted deferrals.

So why not give that to those 178 as well?

Amanda Rivera, an emergency room nurse, told NBC affiliate KPRC that she is among the suspended employees and faces termination if she refuses to comply.

“I feel like they kind of bullied us into this little corner like you have to do it or you don’t have a job. This is my only source of income,” Rivera said.

    Blackmail!  Coercion!  Unacceptable!  Unethical!

The Equal Opportunity Commission said in a guidance issued last month that federal guidelines do not prohibit employers from requiring the Covid-19 vaccines so long as there are reasonable accommodations made under the American Disabilities Act.

    Reasonable accommodations?

Sure does not sound like they even TRIED.

Do it by this date, or you are suspended.  Have it done or you are fired!

That is not a reasonable accommodation.  That is authoritarianism, and is anti-american!

    Update:

Judge tosses lawsuit against hospital over staff vaccine mandate

A Texas judge dismissed a lawsuit against Houston Methodist Hospital over its policy that mandated all staff needed to be vaccinated against COVID-19 or face suspension.

    Why?

In her five-page decision issued Saturday night, U.S. District Judge Lynn Hughes rejected the plaintiffs’ complaint that the COVID-19 vaccines were unsafe.

And what are the long-term side effects?  What, there is no study on it?  I wonder why!

The judge added that Texas law only protects employees from wrongful termination if they refuse to commit an illegal act.

An illegal act?  The threat of termination if you do not accept a chemical into your own body, is not illegal?

Jared Woodfill, the attorney representing the plaintiffs, told ABC News in a statement that he plans on appealing the decision.

    Of course appeal!

…said the case is “just one battle in a larger war to protect the rights of employees to be free from being forced to participate in a vaccine trial as a condition for employment.”

“All of my clients continue to be committed to fighting this unjust policy,” he said in his statement.

What next?  Force the general public to take all those drugs the armed forces are forced to take

“The other obvious place we would see vaccine mandates is, of course, schools and universities but Gov. [Greg] Abbott’s order that prohibits schools from mandating vaccines short-circuited that tool,” Sepper told ABC News.

In other words, people like Sepper want it so a business, school or institution can demand continued employment, take courses, or visit one MUST become a card member of the CCP, or getting the Mark of the Beast, and/or prove they are a VAX-person (SHOW US YOUR PAPERS) to be allow there since it is not “illegal”?

Personal rights and freedoms are being trampled on.

    This has to stop.

    Otherwise, what is next.

The Lawyer was a dumbass. They should fire him/her and hire one that doesn’t use stupidity.

Hire one that files the case on grounds there is not enough evidence to its safety in the long term and the shots have gone against standards and normal protocols for safety the CDC, FDA and Other Org require. Site the testing time for safety for pick your drugs. Also submit the numerous side effects including death.

This judge through it out because the Lawyer apparently went down the “Goodwins Law” hole. That was stupid.

      In a follow up article:

In a decision at the time, Hughes wrote the plaintiffs were “not just jeopardizing their own health; they are jeopardizing the health of doctors, nurses, support staff, patients, and their families.”

Jeopardizing their own health, by taking a non-fully approved vaccine that is exempt for liability for any and all side effects, including the not yet determined long-term side effects.

      That drug!

Woodfill said many of his clients contracted COVID-19 while treating patients during the pandemic.  “As a thank you for their service and sacrifice, Methodist Hospital awards them a pink slip and sentences them to bankruptcy,” he said.

      But there is no coercion.

Do it against your will or be FIRED!

Do it against your will and we will make sure other such institutions will follow our example and refuse you employment.

Do it against your will or you will never work in the field ever again.

      But there is no coercion.

The judge also said the plaintiffs were not being coerced into getting the vaccine.

“(the plaintiffs) can freely choose to accept or refuse a Covid-19 vaccine, however if she refuses, she will simply need to work somewhere else,” the judge said.

So accept it or find work elsewhere (your FIRED).

That sure sounds like they ARE be coerced into taking it.

And if other medical institutions also makes it a requirement (you must have the jab or no employment here), that means you are forcing these medical professionals into a situation where they are being coerced to take the jab or be jobless.

And one of the arguments for these institutions making it mandatory for all workers are:

“I believe health care organizations have a responsibility to protect immunocompromised and vulnerable patients,”

…“Similar to mandates for flu vaccine, I agree with mandatory Covid-19 vaccination in a health care setting.”

But the flu vaccines are FULLY approved and the known side effects (short term and long term) are KNOWN.

We have not that for the covid jabs.

So I fully understand why someone would NOT want the jab… there are too many unknowns that could have serious consequences to one’s health long term.

153 people resigned or were fired from a Texas hospital system for refusal to get vaccinated

Houston Methodist — one of the first health systems to require workers to be vaccinated against the coronavirus — fired or accepted the resignations of 153 workers on Tuesday, said spokesperson Gale Smith. Smith declined to specify how many of the employees were fired or resigned.

      Why not?

Afraid if you said all 153 were fired, and a class action lawsuit over wrongful dismissal?

      And another domino has fallen!

Tennessee hospital latest employer to announce COVID-19 vaccine requirements

A major children’s hospital in Tennessee is the latest to announce a requirement that all employees be vaccinated against COVID-19, which comes at a time when workplace mandates have sparked showdowns and lawsuits.

      Here we go again.

“By September 10, employees who have refused vaccination or do not have an approved medical or religious exemption will be put on an unpaid administrative leave for two weeks,” wrote Dr. James R. Downing, president and CEO of the Memphis hospital.

      then…

“During this time, they have the opportunity to begin the vaccination process,” he added. “Those who fail to start the vaccination process will be terminated at the end of the two-week period.”

Get the jab or get fired.

The hospital is the latest in a slew of employers — from school districts to airliners — that have announced COVID-19 vaccine mandates as workplaces begin to reopen.

      So what’s next?

Will all employees need to get a tracking CHIP inserted under the skin?

      Here is a first for non-medical staff;

CNN fires three employees for coming to work unvaccinated

NEW YORK (AP) — CNN has fired three employees who violated company policy by coming to work unvaccinated against the COVID-19 virus.

Sadly, ALL the on-air staff needs to be fired for misinformation, biased opinions (they call journalism).

CNN chief Jeff Zucker told staff members of the firing in a memo sent Thursday that reminded them that vaccines were mandatory if they report to the office or out in the field where they come into contact with other employees.

The nazis are on the warpath!

“Let me be clear — we have a zero tolerance policy on this,” wrote Zucker, chairman of news and sports for WarnerMedia.

Just like they have a ZERO tolerance policy for anything not extreme toxic alt-left agenda reporting.

A ZERO tolerance policy for reporting anything GOOD republicans do.

      etc.

A Hospital Finds an Unlikely Group Opposing Vaccination: Its Workers

Another group of hospital workers are righting got their rights.

But these were not just any vaccine resisters. They were nurses, medical technicians, infection control officers and other staff who work at a hospital on Staten Island, which has the highest rate of Covid-19 infection of any borough in New York City.

      New York City!

Some medical workers at the Staten Island hospital are so fiercely opposed that they call themselves “The Resistance” after the rebel faction in “Star Wars.” They are defending what they view as their inherent rights, and their leader is gathering hospital workers from other states in an attempt to create a nationwide movement.

      Apt name.

A spokesman said that the company (Northwell Health) was aiming to get 100 percent of its staff vaccinated and has used a variety of tactics to nudge hesitant workers, like offering them spa days. Before the pandemic, the hospital system encouraged flu vaccinations and required employees who were not vaccinated for flu to wear masks when among patients.

So why not do the same?

Or do they also want to fire so many health care workers when the whole industry is under pressure?

Some protesters, dismissive of scientific data and wary of mandates they say infringe on their civil rights, say they are willing to lose their jobs. Other workers said that they were considering moving out of state, perhaps to Florida, where hospital requirements are looser and the number of deaths and hospitalizations has steadily risen since June.

I am sure other places would be more than willing to take much needed health care professionals.

“Medical professionals are often trained to assess the situation on an individual basis and made a recommendation, and so the notion that there should be a universal health policy that applies to all people and that is determined by the government rather than a medical professional on a case-by-case basis, is contrary to the way they are trained to work,” she said.

Data has done little to dispel an entrenched distrust among some health care workers.

When the government and big pharma wants to dictate HOW things should be, how you should live you life, etc. that is a dictatorship.

Join the kgb/gestapo/ or any group that hates rights and freedoms.  The end is the same.  A dictatorship.

As those group of health care professionals says “Join the Resistance!”

You are either an NPC or you are free.

3 Risks of Imposing Strict Vaccine Mandates

      1. Workplace misconduct may follow.

      Which means?

As Covid-19 vaccines have become divisive, those who aren’t vaccinated may face a hostile environment, bullying, or retaliation from fellow employees.

And what can they do to minimize this?

If an employee is causing strife, … the first step is to have a sit down with that individual and explain that there are some exceptions — medical, religious, or otherwise — for not getting the vaccine, and that individual choices must be respected. It’s crucial that the individual’s reasons for not getting vaccinated remain private, especially if it’s medical, to avoid legal risk.

That should be stated to the employees BEFORE they create a toxic work environment.  Otherwise, the company and the hostile employee can expect a lawsuit over it!

      *** *** ***

      2. Expect some turnover.

Not just turnover, but those refusing to return back to work.

Businesses have to consider that some mandates may potentially deter new hires or cause others to leave.

And how woke it is, is also a consideration to potential employees.

What’s critical is to stick to any mandate put in place. It is legal to terminate an at-will employee who doesn’t get vaccinated. However, it’s crucial that it’s made clear that that mandate is a condition of employment prior to termination, or else there may be confusion or push back from employees who feel unrightfully terminated.

And those employees should rightly feel they were unrightfully terminated.

“One might argue that an invasive medical procedure falls under that umbrella. You don’t expect your employer to be asking you to take something into your body through a needle as part of your as part of your duties.”

      Exactly.

      *** *** ***

      3. There’s always legal risk.

      Such as?

…if an employer mandates the vaccine and an employee has some sort of severe reaction to it, causing serious illness or injury, the employee could be entitled to workers’ compensation benefits.

Short term and LONG term reactions? ! ?

Also, don’t forget about unions. If employees are represented by a union, business owners must abide by that collective agreement… So make sure any imposed mandates don’t conflict with a previous bargaining agreement.

So in this case, a union and a CBA might be a good thing.  Who Knew?

Scary how they report some places won’t recognize exemptions (religious or otherwise), and that some medical organizations are threatening to disbar doctors who give out “medical exemptions”.

Poll: 70 percent of people would quit their job over exemption-less vaccine mandate

About 70 percent of unvaccinated Americans who are not self-employed said they would likely quit their job if their employer mandated COVID-19 vaccines and did not grant religious or medical exemptions, a new Washington Post/ABC News poll found.

      That low?

…16 percent from that group would comply with the mandate, while 35 percent said they would seek an exemption and 42 percent would leave. If there’s no exemption, then 72 percent of those surveyed said they would quit.

So forced mandates would lead to potentially more unemployeed?

How does that help the economy?  The nation?

      It does not.

And if the government refuses unemployment benefits as an additional means of blackmailing the population….

No jab, no pay: Quebec gives health-care workers deadline to get fully vaccinated

Quebec health-care workers in both the public and private systems who are not adequately vaccinated by Oct. 15 will be suspended without pay, the province’s health minister, Christian Dubé, announced Tuesday.

      Whom does that mandate cover?

In a statement, the health ministry said this includes doctors, midwives, professionals in private clinics and volunteers.

      Not a good sign.

“We are going to have to reorganize the health-care system.”

Well, we already know how horrible quebec’s for-profit senior’s homecare is.

He said though the hospitalizations may not be as high as early on in the pandemic, they are already straining the system because of a lack of personnel.

And by suspending without pay more workers, how will that help a system already strained with lack of qualified workers?

It will only make it worse!

Legault said the government is trying to come up with ways to convince people who have left the profession to come back, by potentially introducing incentives including increasing pay and improving working conditions.

      By suspending them?  Firing them?

Who wants to put up with that?

He called on federal leaders to make increasing health transfers a priority in the election campaign.

Quebec is already getting too much in transfer payments.  And they want even more?

13 per cent of eligible Quebecers still don’t have vaccine

Is that all? And they are threatening that 13% with nazi-era “show us you papers/covid-passport” or …

At the briefing, Dubé also announced Quebec’s vaccine passport requirement will apply to people visiting hospitals.

The passport came into effect one week ago — on Sept. 1. It is required for most non-essential services, including for restaurant and bar dining rooms and terrasses.

      Discrimination!

Judge Issues Temporary Restraining Order Against New York Governor Over Vaccine Mandates

The United States District Attorney on Tuesday granted a temporary restraining order against New York Governor Kathy Hochul on behalf of 17 health workers claiming the state has violated their Constitutional rights by mandating to receive the COVID-19 vaccine.

Hopefully this will be the first of many issued.

In Dr. A, et al. v. Kathy Hochul, health professionals, including doctors and nurses, are suing the state of New York for violating their Title VII and Constitutional rights with the Covid-19 vaccination mandate while disallowing religious exemptions.

      👍

A lawsuit filed Monday by the plaintiffs sought the temporary restraining order and a preliminary injunction, and then a permanent and final injunction against the vaccine mandate’s prohibition of accommodations of “sincere religious beliefs.”

      And they are?

Specifically, their religious beliefs call for them to “refuse vaccination with the available COVID-19 vaccines, all of which employ aborted fetus cell lines in their testing, development, or production,” according to filed documents.

      Exactly!

… in addition to violating the Supremacy Clause of the United States Constitution by purporting to strip away Title VII protections, the vaccine mandate also violates the Free Exercise Clause of the Constitution by subjecting those who have conscientious religious objections to the vaccine to termination from employment and irreparable damage to their professional standing. That’s while it exempts others from the mandate for more favored secular reasons.

So this sleepy joe over-reach is illegal and needs to be stopped.

And it is not just healthcare workers who needs this.  It is everyone!
